Family Law: Property Division. A mediator can assist you with the equitable distribution of property in a divorce. As in all mediations, the parties must be willing to explore alternative methods in a calm and deliberate manner. The process of mediating equitable distribution disputes saves significant amounts of money in attorneys fees if the parties chose to mediate the matters themselves with the assistance of a mediator.

Role of Attorneys: In mediation, attorneys are limited to consultation. The attorneys are also used for drafting and filing documents, but the attorneys are not involved in the mediation process.

Cost of Mediation: Mediation fees are based on an hourly rate. The hourly rate is dependent upon the nature of the case, the issues to be addressed and willingness of the parties to engage in the mediation process.
